We conduct a comprehensive search of the IP India database to check availability and assess risk of objection.
We identify the correct trademark class(es) from the 45 Nice Classification classes based on your goods/services.
We prepare and file Form TM-A on the IP India portal. You receive a TM application number immediately.
If the examiner raises objections (common), we draft a professional examination reply within the 30-day window.
After acceptance, your mark is published in the Trademark Journal for 4 months. If unopposed, registration is granted.
After filing, you receive a TM application number instantly and can use the ™ symbol. Examination typically takes 3–12 months. If no objection is raised and no opposition is filed after publication, final registration (® symbol) is granted in 18–24 months from filing.
™ (TM) can be used as soon as you file the trademark application — it indicates a pending claim. ® (Registered) can only be used after the trademark is officially registered and the registration certificate is issued. Using ® before registration is a legal offence.
The government fee for trademark registration is ₹4,500 per class for individuals, startups, and MSMEs; and ₹9,000 per class for large companies. These are the IP India filing fees, separate from our professional fee.
Technically yes, but it is strongly advisable to have an attorney file on your behalf. Common mistakes — wrong class selection, incorrect goods/services description, or weak distinctiveness arguments — can lead to rejection or vulnerability to opposition. Our team handles these professionally.
A registered trademark in India is valid for 10 years from the date of filing. It can be renewed indefinitely for successive 10-year periods. Renewal must be filed before expiry — a 6-month grace period exists with an additional fee.
After publication, third parties have 4 months to oppose registration. If opposed, there is a hearing procedure before the Registrar. Our team represents you through the opposition proceedings. We prepare counter-statements and argue the case on your behalf.
